Terms and Conditions

1. Introduction

Welcome to Glimmer ("we," "our," or "us"). These Terms and Conditions govern your use of the Glimmer mobile application (the "App") and any related services. By downloading, accessing, or using our App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree with any part of these Terms, you must not use our App.

2. Use of the App

Glimmer is a conversational journaling app that allows users to create journal entries through AI-assisted conversations. You may use the App only for lawful purposes and in accordance with these Terms.

You agree not to use the App:

  • In any way that violates applicable laws or regulations
  • To transmit any material that is defamatory, offensive, or otherwise objectionable
  • To impersonate or attempt to impersonate any person or entity
  • To engage in any activity that could disable, overburden, or impair the App

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3. User Content

The App allows you to create and store journal entries and other content ("User Content"). You retain all rights to your User Content, but you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and display your User Content in connection with operating and providing our services.

You are solely responsible for your User Content and the consequences of sharing or publishing it. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

4. Privacy

Our Privacy Policy, available at Privacy Policy, describes how we collect, use, and share information about you when you use our App. By using Glimmer, you agree to our collection, use, and sharing of information as described in the Privacy Policy.

5. Intellectual Property

The App and its original content, features, and functionality are owned by Glimmer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. This includes, but is not limited to, the design, text, graphics, logos, and software.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our App, except for your own personal, non-commercial use.

6. Subscription Terms

Certain features or functionalities of our App may be offered on a subscription basis. If you choose to subscribe to these features ("Subscription Services"), you agree to the following terms:

  • Billing: Subscriptions are billed in advance on a recurring basis according to the subscription plan you select within the App. Your subscription will automatically renew for the same period and under the same terms unless you or we cancel it in accordance with these Terms.
  • Cancellation: You can cancel your subscription at any time. No refunds will be provided for any unused portion of the current subscription period. Your access to the Subscription Services will continue until the end of the then-current billing period. For subscriptions purchased through the App Store (Apple) or Google Play Store, cancellation must be done through your account settings in the respective app store
  • Payment: You agree to provide accurate and up-to-date billing information. Payments for subscriptions purchased through our App are facilitated by Apple (through the App Store) or Google (through the Google Play Store). By utilizing these services, you also agree to be bound by the terms and conditions of the respective Payment Processors or app stores.
  • Modification of Fees: We reserve the right to modify our subscription fees at any time. Any changes to the subscription fees will take effect at the end of your current subscription period. We will provide you with reasonable advance notice of any such fee changes. Your continued use of the Subscription Services after the fee change goes into effect constitutes your agreement to pay the new fee.
  • Refunds: Except as explicitly stated in these Terms or as required by applicable law, paid subscription fees are non-refundable. Any consideration for potential refunds for subscriptions purchased directly through us will be made on a case-by-case basis at our sole discretion. For subscriptions purchased through the App Store or Google Play Store, any refunds will be subject to the respective store's refund policies. You will need to contact the appropriate app store directly to request a refund for in-app purchases.
  • Free Trials: We may offer free trial periods for our Subscription Services to new subscribers. If you sign up for a free trial, you will have access to the Subscription Services for the specified trial period. Unless you cancel your subscription before the end of the free trial period, you will automatically be charged the applicable subscription fee for the next billing cycle at the end of the trial. We reserve the right to modify or terminate free trial offers at any time without notice.
  • Promotions: Any special offers or promotions related to our Subscription Services are subject to their own specific terms and conditions, which will be provided to you at the time of the offer. In the event of any conflict between these Terms and the terms of a specific promotion, the terms of the promotion will govern.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our App, except for your own personal, non-commercial use.

6. Third Party Services

The App may contain links to third-party websites or services that are not owned or controlled by Glimmer. Glimmer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Glimmer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability or functionality of these third-party services.

7. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Glimmer be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
